This Auction Sale is for (2) Separate Residential Structures to be Sold as Personal Property & relocated by the buyer at the buyers expense. Structures must be removed by November 17, 2025. Old Oregon Inlet Road, Nags Head, NC 27959 (Structure 1) "9129 S. Old Oregon Inlet Road, Nags Head, NC 27959 (Structure 2) Bidders Agree to Comply with Dare County & the Town of Nags Head, NC Laws & Regulations as well as adhering to Local & Federal Laws, Rules & Regulations. House Moving Permits: Per NCDOT rules, a $20 house move permit is required, submitted at least 2 days prior to the move (application via connect.ncdot.gov). Moves are preferred on Sundays to minimize traffic impact. Building Permits: Buyers must obtain a relocation/moving permit from the Town of Nags Head Planning & Inspections Department (nagsheadnc.gov/254/Permitting-and-Inspections) and/or Dare County Building Inspections (darenc.gov/departments/planning/building-permits-inspections). This includes inspections for structural integrity before and after the move. Fees vary (contact for quote); online applications available for contractors. Septic Permits: For relocation, a new Improvement Permit and Operations Permit are required from Dare County Environmental Health (darenc.gov/departments/health-human-services/environmental-health-services). This involves soil evaluation, site inspection, and compliance with NC Onsite Wastewater Rules (15A NCAC 18A .1900). No existing septic system transfers with the structures. Zoning and Relocation: The new site must be in Nags Head (or compliant Dare County area) and meet local zoning setbacks (e.g., front: 30 ft; side: 12-15 ft per Nags Head Code Article 7), CAMA regulations, and floodplain rules. Buyer is solely responsible for verifying zoning via Nags Head Zoning Administration (nagsheadnc.gov/224/Zoning-Administration). General: Removal must not damage the site, and all local/state/federal laws apply (e.g., NC Residential Code for post-move reconnection). Estimates for moving costs are informational only and not guarantees. ________________________________________ TERMS AND CONDITIONS OF SALE 1.Nature of Sale This auction is for the sale of (2) above listed residential structures only (to be sold separately). The structures have been donated to the Seller and are being sold "AS IS, WHERE IS" with no warranties, express or implied, regarding condition, fitness for purpose, or compliance with codes. The physical land & its contents below ground surface at the addresses remain the property of the original owner and are not in any way included in the sale. No refunds, exchanges or exceptions will be made. 2.What's Included Each of the (2) Structures (sold separately) include the contents present in the auction catalog photos. Each structure includes a stove, microwave and dishwasher, hot water heater, HVAC system and W/D hook-up. Additional Fixtures located below ground level (underground) are excluded unless specified. The septic system & its components are not included in the sale. Buyer assumes all risks of loss to life or damage to the property post-auction close and will in no way hold Island Auction Co or the Seller liable. 3.Bidding and Auction Process BIDDERS MUST ALREADY OWN LAND IN NAGS HEAD, NC where they can legally move the structures to. (THIS WILL BE VALIDATED PRIOR TO BIDDING APPROVAL) Bidding is open to qualified bidders only (18+ years, providing ID and proof of funds if requested). Auctioneer reserves the right to reject bids, set reserves (if any), or withdraw lots. Highest bidder shall be the Buyer; all bids are final. Buyer's premium: [10% of hammer price]. Total price = hammer price + premium + applicable taxes. Online bidding terms apply per Auctioneer's standard policies. 4.Payment Terms Full payment due via CASHIER'S CHECK within 72 hours of auction close, payable to Island Auction Co. No personal checks, credit cards, or financing. Wire transfers accepted with prior approval (fees borne by Buyer). Island Auction Co will charge a 10% Buyers Premium which will be retained by the auction co for services rendered. Invoice includes: hammer price + 10% buyer's premium + 6.75% NC sales tax on hammer price. Example: $50,000 hammer price = $50,000 + $5,000 premium + $3,375 tax = $58,375 total. Failure to Pay with 72 hours & make contact sufficient with the intent to follow through may result in forfeiting your bid which will pass the winning bid onto the backup bidder. 5.Bidder Qualification: DUE TO THE QUICK SALE NATURE OF THIS AUCTION BIDDERS MUST PROVIDE: PROOF OF OWNERSHIP OF VACANT LAND IN NAGS HEAD, NC where they intend to relocate the structures. BIDDERS MUST REGISTER PRIOR TO THE LAST 24 HOURS OF THE CLOSE OF THE SALE BIDDERS MUST PROVIDE A VALID ID & PROOF OF FUNDS (e.g., bank statement or financial institution letter) showing ability to cover bid, 10% buyer's premium, 6.75% NC sales tax, and estimated relocation costs ($32,000-$60,000 per structure). Auctioneer reserves the right to reject unqualified bidders or bids. Only pre-qualified bidders may participate. 6.Removal and Relocation Requirements (BE AWARE OF YOUR TIMEFRAME) Winning Bidder must already own or have legal access to a property within Dare County / Nags Head, NC in which to move the structure to while adhering to local laws, ordinances & guidelines including those which may not be mentioned within these T&C. Winning Bidder must remove the structure from the site within 30 days of auction close (or as extended in writing by Seller) by means of a licensed & insured professional house moving company. Removal at Buyer's sole expense and risk; Seller provides reasonable access but no utilities post-auction. Winning Bidder is Responsible for: Obtaining all permits, including: Town of Nags Head house moving permit. NCDOT house move permit ($20 fee; apply 2+ days prior; Sunday moves preferred). Dare County Building Permit for relocation and inspections. Dare County Environmental Health Septic Permit (Improvement Permit for new site evaluation; Operations Permit post-installation). New site zoning approval (must be in Nags Head/compliant area; verify setbacks and CAMA rules). Securing a new location in Nags Head with all utilities (water, sewer/electric if applicable). Hiring licensed movers/contractors; site cleanup to Seller's satisfaction. Coordinating with Dominion Power & NCDOT as Movement is limited based on Dept. of Transportation and Dominion Power - height of power lines and traffic light height. Buyer responsible for reconnecting plumbing and power to second floor. 9129 S. Buyer indemnifies Seller and Auctioneer against claims arising from removal/relocation, including environmental damage or neighbor disputes. Properties sold subject to all applicable Dare County/Nags Head/NC/state/federal laws; non-compliance voids sale at Auctioneer's discretion. 8.Default and Remedies Default (non-payment, non-removal, permit failure): Buyer liable for all costs (legal fees, resale losses). Auctioneer may retain deposit (10% of bid if applicable) as liquidated damages. Force majeure: Delays due to weather, permits, or acts of God extend timelines reasonably. 9.Governing Law Governed by NC law. Disputes resolved in Dare County courts.
