Accepted Terms and Conditions:
All persons participating in the on-line bidding agree to and accept these terms and conditions unequivocally and without exception. All items are sold AS IS, WHERE IS with NO warranties implied or expressed. No allowance, refund or set aside will be made on account of any incorrectness, error in cataloging, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the Buyer to have inspected thoroughly the items and come to a state of satisfaction as to its condition and value and to bid based solely upon that judgment. By participating in this auction you agree that Clark Auction Company, LLC, nor its employees or affiliates will be held responsible for any errors in descriptions or any failure to execute a bid on behalf of any participant(s) for any reason whatsoever. By submitting winning bid(s) on this auction, you acknowledge and accept without recourse that you have purchased the above items at public auction "as is, where is" without warranty or guarantee of any kind. You will not stop payment, dispute or otherwise contest this transaction.

Vehicle Title Transfers:
All vehicles are sold with Title transfer ONLY. It is the responsibility of the buyer to make repairs, get inspection, and register the vehicle at their county office. All vehicle title paperwork MUST be made out in the registered bidder's company or personal name exactly as it appears on the winning bidder's online account at the time of auction close. No changes/transfers will be made and updating your online account information AFTER the item closes will not update your title paperwork information. A valid form of photo ID must be rendered at check out. Vehicles marked with NO TITLE are subject to standard 6.75% sales tax. CAC, LLC is not responsible for any part of the process or expense of a bonded title. No exceptions!

Full and complete payment must be received by 5:00 p.m. on Weds, June 15, 2016
Additional charges to the hammer price may include State sales tax 6.25%, title transfer fee $13, Texas Fees $21, Document Fee $40, Buyers Tag $5

CASHIER'S CHECK/US MONEY ORDER made payable to Clark Auction Company, LLC can be mailed to 8896 N. Hwy 6, Crawford, TX 76638 with a printed copy of the invoice.

CLARK AUCTION COMPANY, LLC IS REQUIRED BY LAW TO COLLECT THE FOLLOWING TAXES:
SALES TAXES
Texas Sales Tax of 6.75% will be collected on all non-titled items unless the items are being purchased for qualified:
" resale under a valid Texas Sales and Use Tax Permit;
" farm/agriculture exempt use;
" timber operations exempt use;
" research exempt use; or
" non-profit exempt use.
Applicable forms and ID must be presented to qualify for a non-taxed purchase. Texas Sales and Use Tax Resale Certificate; Texas Agricultural Sales and Use Tax Exemption Certificate; Texas Timber Operations Sales and Use Tax Exemption Certificate; Texas Qualified Research Sales and Use Tax Exemption Certificate; or Texas Sales and Use Tax Exemption Certificate.

OFF-ROAD, HEAVY DUTY DIESEL SURCHARGE
2% will be collected on all off-road, heavy duty, diesel construction equipment unless being purchased for qualified resale under one of the exemptions listed above.

Item Removal:
Monday - Friday 9:00am - 4:00pm.
Failure to remove property by Friday, June 17, 2016, the buyer forfeits all monies paid and the property reverts to Clark Auction Company, LLC with no recourse. Removal is the full responsibility of the winning bidder. Please present a copy of your paid receipt and a valid picture ID when picking up all items. Written authorization must be provided to Clark Auction Company, LLC allowing a person other than the buyer named on the paid receipt to pick up items.

Notice of "Soft Closing":
Each auction item is scheduled to end at a specific time. However, all Online auctions performed by Clark Auction Company, LLC use a "Soft Close" feature. Thus, bidding will still remain open on any item that receives a bid within the last 5 minutes prior to the scheduled closing time. Time extensions are added in 5 minute intervals to the original auction closing time and to each extension's closing time when a bid is placed. For example: if an item is scheduled to close at 10:00am, and a bid is placed between 9:55am to 10:00am, the closing time will be extended by 5 minutes until 10:05am. If a bid is placed within that 5 minute interval, then bidding the closing time will extend until 10:10am, etc… Once a 5 minute extension interval has passed without any bids, the auction for the item will close, and the lot will show as COMPLETED. Click the "Refresh" button on your web browser frequently before that item closes and during any extension periods. Your screen may not "auto-refresh," and you may not see bids placed after yours if you don't manually refresh.

The bidder acknowledges and accepts that Clark Auction Company, LLC does not guarantee continuous, uninterrupted service or secure access to our website. Operation of our website may be interrupted, interfered with or adversely affected by numerous factors or circumstances outside of our control. Neither Clark Auction Company, LLC nor any of its sellers, agents, or any provider or third-party vendor will be liable for nor have any responsibility for any loss or damage incurred in the event of any failure or interruption of the website or internet bidding, or from any other cause regarding access to or inability to access the site or its materials, or to place bids whatever the perceived cause. In the event of service interruption during the course of internet auctions, Clark Auction Company, LLC and its sellers reserve the right to terminate the interrupted auctions and declare all bids in those auctions null and void, to allow auctions to continue to run after an interruption, to relist and restart affected auctions at the original starting bid or the high bid at the time of the interruption, to restart all auctions containing any lots of merchandise affected by an interruption or to take any other action deemed necessary. The auctioneer's decision, with Seller's consent, shall be final without recourse or liability.
